These Terms and Conditions (“Terms”) govern your access to and use of the website operated by EvalU LLC (“EvalU LLC,” “we,” “us,” or “our”) located at www.evaluhoops.com (the “Site”).

By accessing or using the Site, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not access or use the Site.

1. Intellectual Property Rights

All content on the Site, including but not limited to text, graphics, logos, images, videos, and software, is the property of EvalU LLC or its licensors and is protected by copyright and other intellectual property laws. You may not use, reproduce, distribute, or create derivative works from this content without our express written permission.

2. User Accounts

If you create an account on our Site, you are responsible for maintaining the confidentiality of your account information, including your password. You agree to accept responsibility for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.

3. Prohibited Conduct

You agree not to use the Site to:

Violate any applicable laws or regulations.
Infringe upon our intellectual property rights or the rights of others.
Transmit any harmful or malicious code, such as viruses.
Collect or harvest personal data of other users.
Engage in any conduct that restricts or inhibits anyone's use or enjoyment of the Site.

4. Products and Services

We make every effort to display the products and services as accurately as possible. However, we do not guarantee that the descriptions, prices, or other information on the Site are always accurate, complete, or current. We reserve the right to modify or discontinue any product or service without notice.

5. Payment Terms

All payments for products and services are processed through a third-party payment provider. By making a purchase, you agree to the terms and conditions of that payment provider. We are not responsible for any issues arising from the payment process.

6. 100% Tuition Credit Policy

We offer an "Earn-As-You-Learn" 100% Tuition Credit Guarantee for our online course offerings. Under this policy, enrolled users may earn store credit equal to one hundred percent (100%) of the net tuition paid toward course enrollment, applicable toward eligible higher-tier products or services (including our $750 Comprehensive Evaluation).

Eligibility & Requirements: To qualify for the 100% Tuition Credit, the user must meet all of the following requirements within six (6) months (180 calendar days) from the original date of purchase or subscription start date:

Complete 100% of all course video and text lessons (122 lessons).
Achieve a passing grade on all course quizzes (12 quizzes).
Complete and submit all required course worksheets, assignments, and exercises (26 assignments).

Non-Cash Refund Disclaimer: The Tuition Credit Guarantee provides internal store credit only toward future services offered by EvalU LLC. It is strictly not a cash-back refund. Under no circumstances will completed course payments be refunded in cash or credited back to the original credit/debit card on file under this policy.

Credit Calculation & Redemption:

The credit amount will equal 100% of the actual net fees collected by EvalU LLC for your course access (e.g., $500 for single upfront purchases, or total accumulated $69 monthly subscription payments made prior to completion). Free trial periods ($0) do not accumulate credit.
Upon completing all requirements within 180 days, you must email support at coachparks@evaluhoops.com to request your credit code.
Issued credit codes must be redeemed within ninety (90) days of issuance, are non-transferable, hold no cash value, and cannot be combined with other promotional discounts.

7. Disclaimer of Warranties

The Site and all its content are provided on an "as is" and "as available" basis without any warranties of any kind, either express or implied. We do not warrant that the Site will be uninterrupted, error-free, or secure. You use the Site at your own risk.

8. Limitation of Liability

To the fullest extent permitted by law, EvalU LLC and its affiliates, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising from your use of the Site.

9. Indemnification

You agree to indemnify, defend, and hold harmless EvalU LLC and its affiliates, officers, employees, and agents from any and all claims, damages, liabilities, and expenses (including legal fees) arising from your use of the Site or your violation of these Terms.

10. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law provisions. You agree to submit to the exclusive jurisdiction of the state and federal courts located in Florida for the resolution of any disputes.

11. Changes to the Terms

We reserve the right to update or modify these Terms at any time without prior notice. By continuing to use the Site after any changes, you agree to be bound by the revised Terms.
